Tonawanda News — LOCKPORT — A Town of Wheatfield man dodged further jail time, but will spend the next five years on probation for abusing his grandmother’s dog.
State Supreme Court Justice Richard Kloch Sr. sentenced Jason Evrard to the 179 days he has already served in the Niagara County jail and the term of probation for his guilty plea to a single felony count of aggravated cruelty to animals.
Evrard, 28, of Nash Road, Wheatfield, was accused of slamming his grandmother’s dog to the ground, fracturing the pet’s pelvis. The dog had reportedly killed a kitten belonging to Evrard’s cat.
Kloch had originally told Evrard he would send him to jail for a year, the maximum possible sentence on the violation of the State Agriculture and Markets Law. Kloch said that by placing Evrard on probation, if he violates the terms and conditions placed on him, he can be sent to state prison for up to four years.
Prosecutors said Evrard’s grandmother told them she thought he’d spent enough time behind bars.
The judge said Evrard “deserved” every day he spent in jail “and more.”
The incident occurred in May, when Abby, an 8-year-old Lhasa Apso, got into a room where Evrard’s cat and its kittens had been living. The dog then, somehow, killed one of the kittens.
Evrard has a criminal record that includes an assault charge that followed attacks on two women. He told Kloch he has been taking anger management classes to learn to control his temper.
As part of his probation, Kloch ordered Evrard to continuing taking those classes.
