TUESDAY: Tonawanda man caught selling counterfeit merchandise (12:26 P.M.)

CRIME: Town resident caught with thousands of counterfeit movies after several months of investigating

The New York State Police arrested a Town of Tonawanda resident for selling trademark counterfeited merchandise at a retail booth in Antique World in Clarence.

Last fall, state police received a complaint of a subject that was selling the merchandise, according to the state police statement. State police investigators in Clarence, along with state investigators from the Special Investigations Unit in Buffalo, conducted the investigation with the Motion Picture Association of America.

David A. Cook, 47, 373 Fairfield Ave., was operating the booth where he was found with about 1,500 counterfeit DVD movies that he was selling for $5 each, according to the statement.

NYSP Special Investigations Unit and Town of Tonawanda police searched Cook’s residence and seized about 6,000 counterfeit movies, according to the statement. Police also found untaxed cigarettes.

Cook was arrested Sunday with felony charges of first-degree manufacture or sale of unauthorized recording of a performance, first-degree failure to disclose origin of a recording and second-degree trademark counterfeiting, according to the statement. Cook was also charged with possession of untaxed cigarettes and attempt to evade/defeat New York State Tobacco Products Tax, both NYS tax law misdemeanors.
